Subject: 9574/1991-098 Starkey Printing Date: Mon, 27 Feb 1989 12:20:00 -0500 1991-098 Starkey Printing Company ORDINANCE NO. 9574 AN ORDINANCE CLOSING AND ABANDONING AN ALLEY LOCATED SOUTHWEST FROM EAST 30TH STREET, BETWEEN 10TH AVENUE AND DODDS AVENUE, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned an alley located southwest from East 30th Street, between 10th Avenue and Dodds Avenue, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: A 15 foot wide alleyway beginning on the southwest line of East 30th Street 150 feet northwest of the intersection of the southwest line of East 30th Street with the northwest line of Dodds Avenue, said point being the northwest corner of lot 141, block 16, East Lake Mission Ridge Land Company's Subdivision, as shown by plat of record in plat book 2, page 25, R.O.H.C., thence southwest 200 feet with the northwest line of lots 141-144, block 16, said subdivision, to the southwest corner of said lot 144, thence northwest 15 feet to the southeast corner of lot 153, block 16, said subdivision, thence northeast 200 feet with the southeast line of lots 153-156, block 16, said subdivision, to the southwest line of East 30th Street, thence southeast 15 feet with East 30th Street to the point of beginning. Said alley separates lots 141-144, block 16, from lots 153-156, block 16, said East Lake Mission Ridge Land Company's Subdivision. Tax Map No. 1560-J-15, and 24-27. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 2. The City of Chattanooga has a sewer located within said right-of-way and reserves an easement the width of the right-of-way for the purpose of maintaining said sewer. 3. The construction of and acceptance by the City Traffic Engineer of a hammerhead turnaround at the north end of the open portion of the alley. 4. The areas reserved for utility easements must be kept free and clear of all structures. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law, provided that this Ordinance shall not be operative until the completion of condition No. 3 in Section 2 above.
